Terms of service

1. The service

RetroFill creates a new git repository on your GitHub account, with a name you choose, containing commits whose author and committer dates you selected or generated, and pushes that repository to GitHub once (a “Fill”). RetroFill also offers Autopilot, a subscription that adds a small number of commits per day, on days you have not otherwise contributed, to one repository you name. Previews of contribution graphs are computed in your browser from GitHub’s public data and push nothing.

RetroFill is an independent product. It is not affiliated with, endorsed by, or sponsored by GitHub, Inc. “GitHub” and the Octocat are trademarks of GitHub, Inc.

2. Eligibility and accounts

1. You must be at least 16 years old, or the age of majority where you live if that is higher, and able to enter into a binding contract.
2. You need a GitHub account you own and control. You are responsible for that account and for everything done through it with the Service.
3. You must give us accurate information (for example your timezone offset, which determines commit timestamps) and keep your GitHub session secure.
4. One account per person. You may not create or use more than one RetroFill account, or use another person’s account.

3. Acceptable use

You agree to use the Service only as follows. Breaching this section is the main reason we would ever suspend an account.

1. Your own account only. You may push Fills and Autopilot commits only to the GitHub account you signed in with. You may not use the Service to generate activity for any other person or account, whether paid or unpaid, and you may not operate the Service on behalf of others.
2. No misrepresentation. You may not present generated commits or the resulting contribution graph as evidence of specific work, employment, experience, open-source contributions or productivity to an employer, client, educational institution, open-source project or any other third party, and you may not use the Service to enhance candidates or profiles for others.
3. No reselling. You may not resell, sublicense, rent or commercially redistribute the Service or access to it.
4. No circumvention. You may not bypass limits, rate limits, caps, payment or entitlement checks, or access the Service by any means other than the interfaces we provide.
5. Nothing unlawful. You may not use the Service in violation of any law, GitHub’s terms and policies, or the rights of others, including by supplying commit messages or content that is unlawful, infringing or abusive.
6. No invite abuse. Invite rewards are for real, separate people. Inviting yourself, inviting accounts you control, or buying and refunding to trigger a reward is a breach, and we may remove the credits it produced.

4. Your relationship with GitHub

1. Your GitHub account is governed by GitHub’s Terms of Service and Acceptable Use Policies. You are responsible for complying with them. You acknowledge that GitHub may change how contributions are counted or displayed, or take action on accounts, at any time and without regard to the Service.
2. We may pause, cancel or refuse any Fill or Autopilot run if GitHub asks us to, if we reasonably believe it risks your account or ours, or if it exceeds the limits described in the Service. Where we do so for reasons other than your breach, we will refund any unused one-time credit affected.
3. We are not responsible for any action GitHub takes with respect to your account or repositories.

5. Permissions we ask for

1. Signing in grants read-only access (your profile, email addresses and contribution calendar).
2. Executing a Fill requires you to install our GitHub App on the repositories you choose. It may write to those repositories and administer them, so that a Fill can push and undo can delete what it created. GitHub refuses it access to anything else on your account. You can change or remove the installation at any time in your GitHub settings.
3. The Service only creates new repositories, or uses an empty repository you made for it, and only writes to repositories it created. It never modifies a repository that already has commits in it.
4. You may remove the installation, or take repositories out of it, at any time in your GitHub settings. Doing so stops Fills, Autopilot and undo until you set access up again.

6. Purchases and subscriptions

1. Prices are in US dollars. Sales tax or VAT is added at checkout where it applies. Payments are handled by Stripe under its Managed Payments program: Stripe’s Link service is the seller of record for your purchase, sends your receipt, and appears on your card statement as LINK.COM* RETROFILL. We never receive or store your card details.
2. Free use. Previewing is free. One Fill is free if it covers at most 7 days and 20 commits.
3. Coffee ($5, one-time) grants one credit, which pays for one Fill covering a single 365-day window. Credits do not expire.
4. Time Machine ($12, one-time) removes the window limit for your account and enables the features listed on the pricing page for as long as the account exists.
5. Autopilot ($3.99 per month or $29 per year) is a subscription that renews automatically at the end of each billing period until cancelled. You can cancel at any time from Billing; cancellation takes effect at the end of the current period, and Autopilot commits stop then. Autopilot includes the Time Machine features while active.
6. We may change prices. Changes to a subscription price apply from the next renewal after at least 30 days’ notice by email or in the app.

7. Refunds

Our Refund Policy is part of these Terms. In short: any purchase is refundable within 14 days while it is unused (Coffee: its credit is unspent and no fill has used a credit since; Time Machine: no Fill has run since; Autopilot: the first charge, before Autopilot has pushed anything), and you can issue that refund yourself from Billing. Otherwise the same button files a request that we answer within two business days. If a Fill fails, the credit it used is restored automatically. A refunded Autopilot charge ends the subscription immediately. Autopilot renewals are not refundable but can be cancelled at any time before they occur.

8. Undo and data deletion

1. Every Fill has an undo action that deletes the repository or repositories that Fill created. Undo is available for as long as the repository exists and the Service has permission to delete it.
2. “Delete account” in Settings deletes your profile, tokens, plans, job logs, Autopilot state, events and our copy of your purchase records from our systems immediately. Stripe and Link keep the payment records the law requires them to keep, as described in the Privacy Policy.
3. Repositories already on GitHub are not affected by deleting your RetroFill account. Use undo first, or delete them on GitHub.

9. Content and ownership

1. The files and commit messages the Service generates into your repository are yours. We assign to you whatever rights we have in that generated content, and we claim no rights in your repositories.
2. Custom commit messages you provide remain yours; you grant us the right to use them solely to perform the Fill.
3. The Service itself — its software, design, name and marks — belongs to RetroFill. Except as permitted by law, you may not copy, modify or reverse-engineer it.

10. Availability and changes

1. We aim for the Service to be available continuously, but we do not guarantee it. Maintenance, outages and dependencies on GitHub and Stripe can interrupt it.
2. We may add, change or remove features. If we remove a feature you have paid for and not yet used, we will refund the unused portion.
3. We may discontinue the Service with at least 30 days’ notice; unused one-time credits will be refunded.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. In particular, we do not warrant that GitHub will display any commit on your contribution graph, that it will continue to do so, or that any third party will interpret your graph in any particular way. Nothing on the Service is career, legal or employment advice.

12. Limitation of liability

To the fullest extent permitted by law, RetroFill will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to the Service, however caused. Our total liability for all claims relating to the Service in any twelve-month period is limited to the greater of the amount you paid us in that period and US $50. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the smallest amount permitted by law. Nothing in these Terms excludes liability that cannot be excluded by law.

13. Indemnity

You will defend and indemnify RetroFill against claims, damages and reasonable costs arising from your breach of these Terms, your violation of GitHub’s terms or policies, or your use of generated activity to misrepresent work to any third party.

14. Termination

1. You may stop using the Service at any time and delete your account from Settings.
2. We may suspend or terminate your access if you breach these Terms, if required by law or by GitHub, or if your account is used in a way that threatens the Service or other users. Where termination is not due to your breach, we will refund unused one-time credits and any prepaid, unused subscription period.
3. Sections 9 through 17 survive termination.

15. Changes to these terms

We may update these Terms. The effective date at the top of this page changes when we do. For material changes we will notify you by email or in the app at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules, and the courts of Ontario have exclusive jurisdiction, except that you may always rely on the mandatory consumer-protection laws of the country where you live. Before bringing any claim, please contact us; almost every problem with the Service is fixed by an undo or a refund within a day.
